ARK Marketing is a digital marketing agency based in Warrnambool, Victoria, Australia (ABN 37 903 267 349). We provide marketing automation, invoicing and client management services, delivered through our proprietary marketing platform.

We are committed to handling personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy explains how we collect, use, store and disclose personal information.

  1. Two roles we play

Our own clients information. When you (a business) engage us, we collect information about you and your staff. We are the controller of that information.

Your customers information. When we set up and manage our platform on your behalf (contacts, leads, messages, invoices, bookings), we handle personal information about your customers and leads. We act on your instructions, and you remain responsible for having a lawful basis and consent to collect and use it.

From our clients:
Name, business name, ABN, position, email, phone, postal and business address
Billing details and payment history (card payments are processed by third-party payment providers; we do not store full card numbers)
Login and account details for connected accounts (e.g. Google, Facebook/Meta, domain and website providers)
Communications with us, support requests, onboarding forms and survey responses
Business information you give us, such as branding, customer lists and marketing goals

From your customers and leads (processed on your behalf):
Contact details (name, email, phone), messages, form submissions, appointment bookings, invoices and payment status, call recordings or transcripts (where enabled), tags, pipeline stages and notes
Source information, such as which ad, form or page the person came from

From visitors to our website:
IP address, device and browser type, pages visited, referral source, and cookie/analytics data
Information submitted through website forms, chat widgets or booking calendars

We may also collect information from public sources, social media platforms and referrers.

  1. Why we collect and use it

To provide, set up, manage and support our services
To create, send and manage invoices, quotes and payments
To run automations, campaigns, follow-ups and reporting on your behalf
To communicate with you, including service updates and support
To market our own services (you can opt out at any time)
To meet legal, tax and accounting obligations
To improve our services and website and to keep our systems secure
To resolve disputes and enforce our agreements

  1. Direct marketing and spam

We only send commercial electronic messages (email, SMS) in line with the Spam Act 2003 (Cth). We send them with consent (express or inferred) and include a working unsubscribe option. To opt out, use the unsubscribe link or contact us at [email protected]. We honour opt-outs promptly and within the legal timeframe.

  1. Who we share information with

We do not sell personal information. We share it only with:

Our CRM and automation platform - the system we use to manage contacts, automations, invoicing and communications on your behalf
Service providers that support our platform or business, for example: payment processors (e.g. Stripe, PayPal), SMS and phone providers, email delivery providers, calendar and cloud services, advertising platforms (e.g. Meta, Google), accounting software (e.g. Xero), website hosting and IT providers
Our professional advisers (accountants, lawyers, insurers)
Government and regulatory bodies where required by law
A purchaser, if our business is sold, subject to confidentiality

  1. Overseas disclosure

Our platform and the service providers we use may store or process data outside Australia, including in the United States and potentially other countries. By using our services or giving us your information, you acknowledge this. We take reasonable steps to ensure overseas recipients handle information consistently with the Australian Privacy Principles, but we cannot guarantee that overseas laws will give you the same protections.

  1. Cookies and tracking

Our website and the pages and forms we build may use cookies, pixels and similar technologies (e.g. Google Analytics, Meta Pixel) to measure performance and improve marketing. You can disable cookies in your browser settings, though some features may not work properly.

  1. Security

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, including access controls, two-factor authentication where available, and restricting access to staff who need it. No online system is completely secure, and we cannot guarantee absolute security.

  1. Data breaches

If a data breach is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required under the Notifiable Data Breaches scheme. Where we handle your customers data, we will notify you promptly so you can meet your own obligations.

  1. How long we keep information

We keep information only as long as needed for the purposes above or as the law requires (for example, business and tax records are generally kept for at least 7 years). When it is no longer needed, we will delete or de-identify it.

  1. Access and correction

You may request access to, or correction of, the personal information we hold about you by contacting our Privacy Officer. We will respond within 30 days. We may need to verify your identity and may refuse access in limited circumstances allowed by law, in which case we will explain why.
